Welcome to VA Blue Gems. These Terms & Conditions govern your use of the VA Blue Gems website and your purchase of gemstones, jewelry, mineral specimens and related products from us.

By accessing our website or placing an order, you agree to these Terms & Conditions. Please read them carefully before making a purchase.

1. About VA Blue Gems

VA Blue Gems is a gemstone business based in South Africa, specializing in natural gemstones and related products sourced from Southern Africa and other regions.

Our website provides information about our products and allows customers to purchase selected products online.

2. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, weights, colors and other information are accurate.

However, gemstones are natural materials and may naturally vary in:

• Color

• Shape

• Size

• Inclusions

• Surface characteristics

• Pattern

Photographs may also appear slightly different depending on lighting, photography equipment and the customer's screen settings.

Unless expressly stated otherwise, photographs are intended to represent the actual product offered for sale.

For individual or unique gemstones, the item shown is generally the item the customer will receive.

3. Natural Gemstones and Treatments

Where reasonably known and relevant, VA Blue Gems will disclose whether a gemstone has been treated, enhanced, dyed, heated, stabilized, irradiated, filled or otherwise modified.

Some gemstone varieties commonly occur in both natural and treated forms. Customers should review the individual product description before purchasing.

Where the treatment status of a gemstone cannot be reliably established, VA Blue Gems will not knowingly represent the stone as untreated.

4. Product Availability

Most gemstones are natural and may be limited in quantity. Some products are therefore available on a first-come, first-served basis.

Adding a product to your shopping bag does not guarantee that the product has been reserved.

An order is only considered accepted once payment has been received and the order has been confirmed by VA Blue Gems.

If a product becomes unavailable after an order has been placed, we will contact the customer and provide an appropriate resolution, which may include a replacement, alternative product or refund.

5. Prices

All prices displayed on the website are stated in the currency indicated on the website.

Prices may change without prior notice. However, price changes will not affect an order that has already been accepted and confirmed by VA Blue Gems.

Unless expressly stated otherwise, displayed product prices do not include shipping, customs duties, import taxes, clearance charges or other charges imposed by the destination country.

6. Orders

Customers are responsible for ensuring that all information supplied during checkout is accurate, including:

* Full name

* Email address

* Telephone number

* Delivery address

* Billing information

* Product and quantity selected

VA Blue Gems reserves the right to decline or cancel an order where there is a reasonable basis to believe that:

* The product is unavailable;

* Pricing or product information contains a material error;

* Payment cannot be verified;

* The transaction appears fraudulent or unauthorised; or

* The order cannot reasonably be fulfilled.

Where payment has already been received for an order that VA Blue Gems cancels, the customer will be contacted regarding the applicable refund.

7. Payment

We accept the payment methods displayed at checkout.

For bank-transfer payments, an order may remain pending until the payment has been verified.

Customers are responsible for ensuring that the correct payment reference and amount are used.

VA Blue Gems is not responsible for delays caused by banks, payment processors or international financial institutions.

8. Shipping and Delivery

Shipping options and applicable charges are displayed at checkout where available.

Delivery times are estimates and are not guaranteed unless expressly agreed otherwise in writing.

Delivery may be affected by:

* Courier delays

* Customs procedures

* Import requirements

* Weather

* Public holidays

* International transportation disruptions

* Incorrect or incomplete delivery information supplied by the customer

For international orders, the customer is responsible for complying with the import regulations of the destination country and for paying any applicable customs duties, taxes, clearance fees or other charges imposed by the destination authorities.

9. Risk During Delivery

Risk in the goods passes to the customer upon delivery to the delivery address provided during checkout, subject to applicable law and the terms of the relevant courier service.

Customers should inspect packages upon receipt and notify VA Blue Gems as soon as reasonably possible if the package appears damaged or the contents are missing or damaged.

Where appropriate, customers may be required to provide photographs or other evidence to support a delivery or damage claim.

10. Returns and Exchanges

Because gemstones may be unique, individually selected and subject to availability, returns are handled on a case-by-case basis.

A customer wishing to return an eligible product must contact VA Blue Gems within 7 days of receiving the order.

The product must:

* Be unused;

* Be in its original condition;

* Include its original packaging where applicable; and

* Not have been altered, damaged or modified by the customer.

The customer is responsible for return shipping costs unless the product was incorrectly supplied, defective, or otherwise eligible for a seller-funded return under applicable law.

Refunds will generally be processed after the returned product has been received and inspected.

Nothing in this section limits any rights that a consumer may have under applicable consumer-protection law.

11. Non-Returnable Products

Unless otherwise required by applicable law, the following may not be eligible for return:

* Custom-made or specially prepared products;

* Products altered at the customer's request;

* Products damaged after delivery through customer handling;

* Products specifically purchased under wholesale or bulk arrangements where different terms were agreed; and

* Products that have been mounted, cut, polished, drilled, treated or otherwise modified after purchase.

12. Wholesale and Bulk Orders

Wholesale and bulk orders may be subject to separate pricing, minimum order quantities, payment requirements, shipping arrangements and return conditions.

Where a wholesale customer receives a quotation or separate sales agreement from VA Blue Gems, those specific terms will take precedence over conflicting general website terms.

Wholesale customers are responsible for confirming product specifications, quantities, grades, sizes and other requirements before placing an order.

13. Gemstone Identification and Grading

Descriptions of gemstone type, origin, colour, quality, treatment and other characteristics are based on information reasonably available to VA Blue Gems at the time of listing.

Unless a product is accompanied by an independent laboratory report, product descriptions should not be interpreted as a formal gemological certification.

Where a gemstone is sold under a commercial or trade name, the product description will be used to clarify its nature where necessary.

14. Certificates and Laboratory Reports

Where a gemstone is supplied with a certificate or laboratory report, the certificate relates only to the specimen identified in that report.

Customers requiring independent verification may arrange additional testing with a qualified gemological laboratory at their own expense.

15. Website Content

All text, photographs, graphics, logos, product descriptions and other original content published by VA Blue Gems are protected by applicable intellectual-property laws.

You may not reproduce, modify, distribute, sell or commercially exploit our content without prior written permission.

16. Website Availability

We aim to keep the website available and accurate but do not guarantee that the website will always operate without interruption, errors or technical problems.

We may temporarily suspend or modify the website for maintenance, security, updates or other operational reasons.

17. Limitation of Liability

To the maximum extent permitted by applicable law, VA Blue Gems will not be responsible for indirect, incidental or consequential losses arising from the use of the website or the purchase or use of our products.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

18. Fraud and Unauthorized Transactions

VA Blue Gems reserves the right to conduct reasonable checks on orders and payments to prevent fraud, theft and unauthorised transactions.

Where an order is reasonably suspected to involve fraudulent activity, we may delay, suspend or cancel the transaction.

19. Privacy

Customer information is handled in accordance with our Privacy Policy.

By placing an order, customers acknowledge that certain information is required to process payment, fulfil orders, communicate with customers and arrange delivery.

20. Changes to These Terms

VA Blue Gems may update these Terms & Conditions from time to time.

The latest version will be published on this website with the applicable effective date.

Changes will not retrospectively alter the agreed terms of an order that has already been accepted unless required by law.

21. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of South Africa, unless applicable law requires otherwise.

Any dispute arising from the use of this website or the purchase of products from VA Blue Gems will, where applicable, be subject to the jurisdiction of the courts of Zimbabwe.
